Please read these Terms and Conditions (“Terms”) carefully before using glenaryscafe.com (the “Site”) or placing any order with Glenary’s Cafe (“we”, “us”, “our”).

By accessing or using our Site, placing an order, or registering an account, you (“the Customer”, “you”) agree to be bound by these Terms. If you do not agree, please do not use our Site or services. These Terms constitute a binding legal agreement under the laws of India.

Glenary’s Cafe is a bakery and food retail business registered and operating in Siliguri, West Bengal, India. Our FSSAI licence number is displayed at our outlets. Our website is operated at glenaryscafe.com.

2. Eligibility

  • You must be at least 18 years of age to place an order or register an account on our Site.
  • By using our Site, you represent that you are of legal age and have the legal capacity to enter into a binding contract under Indian law.
  • You may browse the Site as a guest, but account registration is required to place orders.
  • We reserve the right to refuse service to any person at our sole discretion.

3. Products & Menu

All products listed on our Site are subject to availability. We reserve the right to:

  • Modify, discontinue, or substitute any product without prior notice
  • Correct pricing errors at any time before an order is confirmed
  • Limit quantities of any product available for order

Product photographs on the Site are for illustrative purposes only. The appearance of the final product may vary slightly from images shown. This does not constitute a defect.

3.1 Allergen & Dietary Information

Our bakery produces products containing common allergens including but not limited to gluten, dairy, eggs, nuts, and sesame. While we take care to avoid cross-contamination, we cannot guarantee that any product is entirely free from allergens. If you have a severe allergy or specific dietary requirement, please contact us via WhatsApp before placing your order.

We do not accept liability for adverse reactions caused by failure to disclose allergies or dietary requirements at the time of ordering.

3.2 Next-Day Delivery Model

All products on glenaryscafe.com are prepared fresh and dispatched on a next-day delivery basis. Orders must be placed by 10:00 PM to be delivered the following day, subject to delivery availability in your area. Delivery on Sundays and public holidays may be subject to additional lead time.

4. Pricing & Payment

  • All prices are listed in Indian Rupees (INR) and include applicable taxes unless stated otherwise.
  • Prices are subject to change without notice. The price applicable to your order is the price displayed at the time of checkout.
  • We accept payment via the payment methods listed at checkout, which may include UPI, debit/credit cards, net banking, and wallets.
  • Payment must be made in full at the time of order placement. Orders are confirmed only upon successful payment.
  • We do not accept cash on delivery unless explicitly stated for specific products or areas.
  • In the event of a pricing error on our Site, we reserve the right to cancel the order and issue a full refund, notifying you promptly.

5. Order Placement & Confirmation

An order placed on our Site constitutes an offer by you to purchase the selected products. A binding contract is formed only when you receive an order confirmation email or message from us.

We reserve the right to reject or cancel any order at our discretion, including where:

  • A product is unavailable after your order is placed
  • A pricing or description error is identified
  • Payment has not been received or is declined
  • The order cannot be fulfilled due to operational constraints

In the event of cancellation by us, you will receive a full refund within 5–7 business days.

6. Delivery

6.1 Delivery Area

We currently deliver within select areas of Siliguri and surrounding localities. Delivery availability is confirmed at the checkout stage. We reserve the right to expand or restrict our delivery zone at any time.

6.2 Delivery Time

Orders placed by 11:59 PM are targeted for delivery the following day. Delivery windows are provided at checkout. While we make every effort to deliver within the stated window, delays may occur due to traffic, weather, or operational factors. We shall not be liable for reasonable delays beyond our control.

6.3 Failed Deliveries

If a delivery attempt fails due to an incorrect address, the recipient being unavailable, or failure to respond to our delivery partner’s contact, we may:

  • Attempt redelivery at an additional charge
  • Treat the order as fulfilled without refund, as perishable goods cannot be restocked

It is your responsibility to ensure the delivery address and contact number provided are accurate and that someone is available to receive the order.

6.4 Delivery Charges

Delivery charges, if applicable, are displayed at checkout before order confirmation. Charges may vary based on location, order value, and order type.

7. Corporate Packet Lunch Orders

Corporate packet lunch orders placed through the Glenarys Gather Box page are subject to the following additional terms:

  • A minimum lead time of 48 hours is required for all corporate orders.
  • Cancellations must be submitted in writing (email or WhatsApp) at least 24 hours before the scheduled delivery time.
  • Cancellations made within 24 hours of delivery will not be eligible for a refund.
  • We reserve the right to decline corporate orders that cannot be fulfilled within the requested timeframe.
  • Customised menus and bulk orders are subject to separate pricing agreed in writing prior to order confirmation.

8. Birthday & Celebration Cakes

Custom birthday and celebration cake orders are subject to the following:

  • Orders must be placed at least 24 hours in advance. Custom or complex cakes may require 48–72 hours.
  • Customisation requests (e.g. name, message, colour) must be submitted at the time of order. We cannot guarantee changes after order confirmation.
  • Cakes are bespoke perishable products. Cancellations are not accepted after confirmation except in limited circumstances set out in our Cancellation & Returns Policy.
  • Minor variations in design, colour, or decoration from photographs on the Site do not constitute a defect and are not grounds for a refund.

9. Intellectual Property

All content on glenaryscafe.com — including text, images, logos, menu designs, and graphics — is the property of Glenary’s Cafe or its licensed suppliers and is protected under Indian copyright and intellectual property laws.

You may not reproduce, distribute, modify, display, or commercially exploit any content from our Site without our prior written consent. Unauthorised use may result in legal action.

10. User Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must notify us immediately of any unauthorised use of your account.
  • We are not liable for any loss arising from unauthorised account access resulting from your failure to keep credentials secure.
  • We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

11. Loyalty Programme — Glenary’s Club

  • Membership in Glenary’s Club is free and available to registered account holders.
  • Reward points are earned on eligible purchases and may be redeemed against future orders as per the terms communicated at the time of redemption.
  • Points have no cash value and are non-transferable.
  • We reserve the right to modify, suspend, or terminate the loyalty programme at any time with reasonable notice to members.
  • Fraudulent accumulation or misuse of loyalty points will result in immediate account suspension and forfeiture of points.

12. Limitation of Liability

To the fullest extent permitted by applicable Indian law:

  • Our total liability to you for any claim arising out of or related to these Terms or your use of our services shall not exceed the value of the specific order in dispute.
  • We shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of profit, data, or goodwill.
  • We are not liable for losses arising from circumstances beyond our reasonable control, including natural disasters, power outages, supplier failures, or government restrictions.
  • Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or fraud or fraudulent misrepresentation.

13. Indemnification

You agree to indemnify, defend, and hold harmless Glenary’s Cafe, its directors, employees, and agents from and against any claims, losses, liabilities, damages, costs, or expenses (including reasonable legal fees) arising from:

  • Your violation of these Terms
  • Your use of our Site or services in an unlawful manner
  • Your infringement of any third-party rights

14. Disclaimer of Warranties

Our Site and services are provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding:

  • The uninterrupted or error-free availability of our Site
  • The accuracy, completeness, or timeliness of product information
  • The fitness of our products for any particular purpose beyond food consumption as described

We shall use reasonable endeavours to maintain Site availability but cannot guarantee uptime and shall not be liable for any loss resulting from Site downtime.

15. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Siliguri, West Bengal.

We encourage you to contact us in the first instance to resolve any dispute amicably. If a resolution cannot be reached within 30 days, either party may pursue legal remedies available under Indian law.

16. Force Majeure

We shall not be in breach of these Terms or liable for any delay or failure to perform our obligations where such delay or failure results from circumstances beyond our reasonable control, including but not limited to: acts of God, pandemics, government orders, civil unrest, power failures, floods, or supplier failures. We will notify you as soon as reasonably practicable in such circumstances and make every effort to fulfil pending orders when normal operations resume.

17. Amendments to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our Site or services after any changes constitutes your acceptance of the revised Terms. We recommend reviewing this page periodically.

18. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remaining Terms, which shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and Cancellation & Returns Policy, constitute the entire agreement between you and Glenary’s Cafe with respect to your use of our Site and services and supersede all prior agreements or understandings.
